Overview

Our Creditors' Rights/Bankruptcy practice group represents creditors in bankruptcies and bankruptcy related litigation, contested matters and adversary proceedings including stay litigation, litigating and negotiating cash collateral orders and contesting and negotiating the confirmation of reorganization plans. Our attorneys represent creditors in the defense of preference actions and in the prosecution of dischargeability litigation.

Our practice group represents lenders and borrowers in out-of-court workouts and restructures of problem credits and represents lenders in receivership and foreclosure actions. We also represent clients in the acquisition and sale of assets of troubled companies in bankruptcy and receiverships.

In addition, we represent trustees in the administration and enforcement of defaulted industrial revenue bonds. We also represent clients in the negotiation and documentation of financing loan transactions, including loans and bonds.

Foulston Siefkin's Creditors' Rights/Bankruptcy practice group has the expertise and experience to provide practical results to its clients facing problem credits and credit transactions.
