Profile

Rachel Wetta is a Foulston Siefkin litigation partner with an active trial practice who has led and assisted multiple jury and bench trials in both state and federal court. A member of the firm’s litigation practice group, Rachel has argued in front of the Kansas Supreme Court, Kansas Court of Appeals, and Tenth Circuit Court of Appeals. Her regular practice areas include employment litigation, contract disputes, creditors’ rights, torts, and insurance defense. She also represents clients before various regulatory agencies, including the Kansas State Farm Service Agency and the Kansas State Board of Nursing.

Rachel looks for outcomes that are in her clients’ best interests, which doesn’t always lead to the courtroom. That may mean mediation and other types of alternative dispute resolution to protect her clients from the risks of going to trial.

Rachel was recognized by Benchmark Litigation as a Labor and Employment Star, named to Benchmark’s Under 40 Hotlist in 2017, and selected to be included in the Missouri & Kansas Super Lawyers Rising Stars list. She is an active member of the state and local bars, as well as the Kansas Association of Defense Counsel and the Defense Research Institute.

Active in the community as well as the legal profession, Rachel serves on the boards of both the Wichita Area Sexual Assault Center and KPTS Channel 8. Rachel is an Iowa native who moved to Wichita after graduating from the University of Iowa College of Law and happily started putting down roots. She and her husband, Trent, have two young children. Rachel is an avid baker who spends her weekends making cupcakes, cheesecakes, pies, baguettes, sourdough bread, cookies, and anything else that looks tasty and sounds challenging.

Relevant Experience
  • Represented a trust company in an action brought by a customer who asserted claims of breach of contract, violations of Kansas Consumer Protection Act, fraudulent mispresentation, and fraud by silence. A jury returned a defense verdict on all but one claim and found that the plaintiff sustained no damages.
  • Defended a company before the Kansas Supreme Court, seeking to overturn a jury verdict against her client for negligent failure to train. The Kansas Supreme Court remanded the case for a new trial.
  • Argued in front of the Tenth Circuit Court of Appeals on behalf of a not-for-profit organization accused of violating a federal regulation in an area where little case law has been established.
  • Plaintiff counsel for a specialty manufacturing company which won an award for past-due payments through arbitration but was never paid. The lawsuit claims include fraudulent transfers under UFTA, conspiracy to engage in a fraudulent transfer, successor liability, and alter ego.
  • Represented a client in an administrative hearing who faced the loss of a professional license after completing the substantive elements of a diversion program but failed to comply with some clerical requirements. Negotiations convinced the Assistant Attorney General to accept a new diversion agreement, and the client kept her license.
