Hutchinson's Heartland Builders Ordered to Pay Redman Family More than $500,000 for Breach of Construction Contract and Negligence

November 7, 2019

Reno County District Court confirmed a judgment of $507,188 against Heartland Builders of Hutchinson on October 16, 2019. Foulston partner Kyle Steadman, lead counsel for Hutchinson plaintiffs Jack and Karie Redman, said the arbitration award found that Heartland Builders had breached its construction contract with the Redmans by overcharging them, negligently constructed their home, and committed two violations of the Kansas Consumer Protection Act. Arbitrator Jerome Bales also awarded attorneys’ fees and expenses.

The Redmans, a family of six whose home was destroyed in Reno County’s 2017 wildfires, were approached by Heartland Builders president Brian Teichman and general superintendent Ralph Dohner. Heartland offered to build a new home at a lower cost compared to other bids the Redmans received. However, the arbitrator found that Heartland Builders overcharged the Redmans and negligently constructed the home.

Steadman notes, “Jack and Karie Redman have been awarded the judgment they’re due against Heartland Builders. The Redmans trusted Brian Teichman of Heartland Builders. Taking more than what you’re owed and building a substandard home added insult to the injury Jack and Karie Redman had already experienced in losing their home to wildfire. This helps the Redman family finally put a home back together.”
