Foulston Siefkin partner Brad Serafine practices in the firm’s Wichita office and handles a diverse range of legal disputes including trust and estate, commercial, insurance defense, and product liability cases. Businesses, individuals, and estate planning lawyers rely on Brad to understand their unique situations, ask the right questions, and craft effective dispute resolution strategies.   

In his trust and estate litigation practice, Brad primarily advocates for family members – children, siblings, relatives, blended families, and others – either to pursue a legal action or defend against one. He represents beneficiaries, trustees, and financial institutions in will and trust disputes concerning disagreements over inheritances, document interpretation, testator capacity, or document validity. Additionally, estate planning attorneys seek Brad’s counsel to help represent their clients in special situations. They trust him to deliver effective representation and protect the relationship they have fostered with their clients.

Brad devotes a significant portion of his practice to commercial litigation cases. Often, these cases involve contract disputes, including disputes over restrictive covenants, confidentiality, and liquidated damages. He also litigates business torts, including defamation, conversion, and tortious interference actions. Brad works with established companies and entrepreneurs from industries that range from manufacturing, financial services, and health care to hospitality, education, and aviation.

On many occasions, Brad has effectively resolved disputes and avoided prolonged litigation by advising companies on a variety of commercial agreements with issues related to breach, warranty, damages, indemnity, limitation of liability, delivery, and payment. Brad also assists financial institutions, businesses, and service providers on creditors’ rights issues, including debt-collection and foreclosure lawsuits.

Brad enjoys the variety and diversity of his law practice, and takes pride in knowing his clients put their trust in him to handle their important matters.

Relevant Experience


  • Represented a landowner in a pasture lease case against a tenant that maintained cattle on the property but failed to pay rent. Obtained a favorable jury verdict for the landowner.
  • Defended the tenant of a dairy farm in claims involving damage to a rotary milking parlor.
  • Defended a manufacturer of commercial irrigation equipment (a self-propelled center pivot irrigation system) in a breach of warranty case.
  • Represents farmers, landowners, lenders, suppliers, co-ops, and feedlots in connection with a variety of disputes and issues from insurance to leasing to property rights.


  • Represented the owner of a boutique Texas hotel in its claims of defective design and construction in arbitration.
  • Represented a steel supplier in its payment claim against a surety company on a KDOT project in western Kansas.
  • Represented a subcontractor on an Army Corps of Engineers project at Marion Reservoir in Kansas.
  • Generally represents architects, general contractors, subcontractors, and owners in and out of litigation and arbitration in connection with contract disputes, warranty issues, mechanic’s liens, defect claims, and professional licensing and liability.

Contract Disputes

  • Represented an industrial client in enforcement of trade secret and non-compete claims against and recovery of stolen technology from former employees.
  • Represented an insurance broker in enforcement of a non-compete clause against a former employee and assertion of a tortious interference claim against a competitor.
  • Represented multi-level marketing clients in a two-week arbitration hearing involving breach of contract claims.
  • Provides dispute resolution advice to manufacturing companies regarding agreements with customers and suppliers, including questions about liquidated damages, limitations of liability, and delivery and payment issues.
  • Represents physicians and medical practices in connection with enforcement and defense of non-compete and liquidated damage provisions.

Creditors’ Rights

  • Represents a large agricultural financing company in pursuing delinquent borrowers and guarantors for repossession of collateral and deficiency judgments.
  • Represents a multinational bank in connection with Kansas mortgage foreclosure lawsuits. Also involved in the defense of counterclaims brought by borrowers asserting violations of statutes including the Truth in Lending Act, Fair Debt Collection Practices Acts, Kansas Consumer Protection Act, and usury laws.
  • Represents a local lender in connection with residential mortgage foreclosure lawsuits. Is involved in every stage of the foreclosure process, from the initial notice to the borrower to the judicial confirmation of the property sale.


  • Represented an employee sued for defamation by her supervisor for statements published on Facebook and by text message. Obtained dismissal of the defamation claim on summary judgment.

Insurance Defense

  • Defends insurance companies and their insureds in a variety of cases, primarily involving personal injury.
  • Defended a landlord against a tenant’s claims for personal injury and breach of the warranty of habitability involving the garage door at the residence.
  • Defended multiple parties involved in the ownership and operation of an ice cream store in a slip and fall case.
  • Defended a global manufacturer of household appliances in a products liability case involving a refrigerator.
  • Defended a foreign auto manufacturer in a multi-million dollar personal injury and products liability case involving the vehicle’s cruise control.
  • Has handled dozens of personal injury, property damage, and wrongful death claims relating to auto accidents, premises liability, fires, and gas explosions.

Shareholder Litigation

  • Defended a majority shareholder, board member, and corporate officer against claims brought by a minority shareholder that was cashed out in a corporate merger.

Trust & Estate Disputes

  • Regularly handles wealth transfer cases involving, for example, powers of attorney, undue influence, intestacy, will validity, enforcement of marital agreements, trust administration, and trustee performance and compensation.
