Tim O’ Sullivan, Stewart Weaver and Steve Neas will discuss what our estate planning department considers the most significant developments since our previous Forum. Such developments will include federal and state legislative developments, judicial decisions and IRS regulations and rulings that have the greatest impact on estate planning professionals. With people living longer and the high incidence of divorce, the odds are much greater today that a person will have been married and remarried, in some instances a number of times. This presents additional challenges to clients and their estate planners or advisors. The introduction of a new spouse into existing families often redefines the roles various family members are to play, including as caretaker, financial fiduciary, companion, confidant, beneficiary, parent, etc. Tim O’Sullivan and Stewart Weaver will discuss in depth various planning techniques specifically designed to help address the unique problems inherent in blended families. Such techniques include the use of trusts established for a spouse upon a client’s death, contractual estate planning arrangements, spousal consents to estate plans, irrevocable trusts (including irrevocable lifetime marital trusts), and other strategies to “lock-down” an estate plan and reduce or avoid future family disharmony. Gary Ayers will join in a detailed discussion of premarital and postmarital agreements, ongoing obligations for former spouses that may arise from divorce proceedings, and other related issues. Attendees will be provided with a better understanding of the estate planning options, many seldom used, to provide for a subsequent spouse, while at the same time providing for family members from a previous marriage with some assurance the plan will not be unwound following the client’s death.
