This conference is designed to provide training and assistance to health care executives regarding the basic fundamentals of Kansas and federal law as applied to health care organizations doing business in the Kansas health care community.  Our program will focus exclusively on areas of the law that impact such individuals on a daily basis and will assist in providing the knowledge and information essential to conduct business and be compliant in this highly regulated environment.

This program is designed to apply to current and future hospital administrators and managers, practice group administrators, nursing home administrators, physicians, board members of private or governmental health care organizations, physicians, CFOs and compliance officers. This conference covers basic state and federal health law different than the Foulston Siefkin Annual Health Law Institute in the Fall which provides an in-depth examination of the most pressing current legal issues impacting health care organizations.

The Big Picture, Part I:

Kansas Health Care Governmental (a) Structure, (b) Control, and (c) Risk Management and Insurance.

Structure. Licensure; Department of Health and Environment (KDHE); Health Policy Authority (KHPA); State Board of Healing Arts (KSBHA); Department of Social and Rehabilitation Services (SRS); Department on Aging (KDOA); State Board of Nursing (KSBN); State Board of Pharmacy (Kansas Board of Pharmacy); Kansas Attorney General - Medicaid Fraud Units; Federal Oversight:  CMS; HHS-OIG; and program safeguard contractors.

Control. Government Surveys and Requests for Documents:  Board of Healing Arts, KDHE Surveys, Attorney General Subpoenas, and other Kansas regulatory agencies requests for information and documents.

Risk Management and Insurance.  Malpractice; standard of care; disclosing and settling unforeseen outcomes; Health Care Stabilization Fund; risk management plans; and risk management reporting.

The Big Picture, Part II:

Kansas Health Care Organizations. Types of Kansas providers: hospitals (for-profit v. nonprofit; governmental v. private), other medical facilities (e.g., ASCs), and physician practices. The organizational documents for the various types of Kansas providers: articles of incorporation, corporate bylaws, and operating agreements.  Relationships between/among health care providers: state and federal restrictions. Types of payors: private/governmental.

Breaking it Down: Governing and Operational Documents for Health Care Organizations. Medical staff bylaws, rules, and regulations; hospital policies, procedures, rules, and regulations; compliance plans; risk management plans.

Advanced Directives and End of Life Issues. Informed consent; advanced directives, including living will and power of attorney; court appointed guardian; DNR.

Special Patients: Consent, Privacy, and Management.  “Things to know” and “recurring issues” when dealing with the mentally ill, minors, guardians and conservators.  HIPAA and other restrictions on the release of medical records containing mental health information.

Employment Law Basics. At-will employment, employee handbooks, and discrimination claims.
